Ready to go: Step 3 of 3 – About your claim

Please tell us when exchange of contracts took place

This is important. A misrepresentation claim is based on the fact that a buyer was induced by a seller to enter into a contract. If you are not sure when exchange and completion took place, leave these dates blank and we can check in due course. A contract is entered into when contracts are exchanged. Therefore, things said AFTER exchange of contracts cannot generally be said to be things that were relied on by the seller which led them to enter into the contract.

We need to consider the contract of sale. It may contain contractual clauses which are relevant to any claim. We can still provide a preliminary assessment of whether or not you have a claim without it, but the contract itself could change our advice significantly, and we would need to see it anyway, if you do decide to take things further. We need to understand why you feel that you have been misled by the seller.

a. Please upload any documents that the seller provided to you (via your solicitor or otherwise) that you relied on when deciding to proceed with your purchase and that you consider are factually inaccurate

These might be things such as the property information form (TA6), leasehold information form (TA7) or your solicitor’s enquiries and the seller’s responses to those. It might be text messages or emails between you and the seller directly, or perhaps between you and the seller’s estate agent (although this is less likely to enable a claim to be pursued). What is important is that the document contains a factual assertion of something that you relied on and which you consider to have been inaccurate.
